Charges Mount in Teen Burglary Case

State’s Attorney adds felony marijuana possession charge to home invasion, burglary and more.

The case of two Deerfield teenagers accused of invading a Highland Park home in August and appeared on the verge of settling earlier this month became more complex today in Lake County Criminal Court in Waukegan.

Assistant Lake County State’s Attorney Steve Sheller told Judge Daniel Shanes he was adding a claim of unlawful possession of marijuana, a Class 4 Felony, to the existing 10 counts of the indictment against Joshua Norris and Joseph Mahoney, both 18, of Deerfield.

Earlier this month, Shanes admonished Mahoney and Norris to make good decisions while they were free on bail because probation was an option in any sentence or plea negotiation that might take place. At that time, attorneys for the defendants suggested the case might end today.

When Sheller told the court of the additional charge, the timing changed. Shanes continued the case until June 11 for a pretrial and set a trial date of July 8. “If I set it then I want you to reach a settlement or we’re going to have a trial,” he said.

The possession count stems from the original investigation following the home invasion in August and has nothing to do with anything Norris or Mahoney have done since then, according to Sheller. He said it was the reason for the delay.

“They need time to look at the new charge,” Sheller said of the defense attorneys’ reasons for wanting more time. “I just gave it to them and have to get them the information. They’ve never seen it before.”

Shanes again told Mahoney and Norris their behavior and decision making in the next few months will weigh heavily in any decision he makes in the ultimate resolution of the case.

“One of the things I look at are the choices you have made, the choices you made in the first place and the ones you will have made while you’re out on bond.” Shanes said. “Make sure that you make good ones.”

At that time Mahoney attorney Chris Cronson suggested there was a relationship between three men. “It came out at the bond hearing (for Norris and Mahoney) that he (Lynn) was a previous source of supply for marijuana,” Cronson said in August. “They weren’t just throwing darts at a dart board.”

Why is this taking SO long to get wrapped up? What happened to a right to a speedy trial? Why is a year of these kids lives gone by with nothing resolved? Let's get a decision and let the kids deal with the results and move forward.

Steve, why did Patch run a story a few weeks back indicating the sense that a plea deal in this sad case was all but worked out? It seemed like premature reporting at the time, almost as if Patch was shilling for the defense team. These kids don't deserve a break, not with a gun involved, and to suggest they had a chance to get a break from the courts does not suggest the kind of justice I think we expect here. Happy to see the prosecutor up the stakes. This is not the kind of first (felony) offense that deserves anything less than a felony conviction.

Sounds like the judge is a fair man, these new charges just clog things up on purpose and are vindictive of the Prosecution. These are kids who were stupid and made a mistake, and have shown over the past year they learned their lesson. THeir lives are ruined as it is, let them put their lives back together and move on. This could be anyone's child, I don't think they deserve 100 years in prison. Shame on the District Attorney, he is wasting OUR TAXPAYER DOLLARS with these additional charges. Marijuana is legal in many states, Illinois should follow suit with this so malicious prosecutions like this cannot happen.

Agreed. Why the marijuana charges now? Seems like that must be the least of the offenses they committed, so what's the point in adding it at this point in the process? It certainly does seem vindictive and just draws out the process and racks up more legal expenses on both sides. If the prosecutor didn't feel it was worth charging them with the marijuana possession last summer/fall, why now? Let's wrap this thing up so everyone can move forward.

This is exactly how I prefer tax dollars to be spent. Gun, drug distribution deal gone bad, home invasion? That is not legal in any state, or in any state that permits medical (or recreational) marijuana use.

Unlawful Possession of Cannabis can be charged as a Class 4 Felony when the amount of cannabis alleged to have been possessed is more than 30 grams but less than 500 grams. Show me which State allows you to possess that much pot legally?

"why the marijuana charge now?" This is purely "procedural" as an excuse for the court to continue the matter so the parties can reach a settlement. The DA stated in the article that the defense needed the time to "review the new charge." wink wink. The judge went along with it. The DA does not want to try the case. There had to be a small hiccup in the settlement so they are giving it more time. The weapon used was not a "gun"...it was a "long gun." a RIFLE! Have you ever heard of a home invasion where a rifle was used? Its laughable. This is about three idiotic Northshore kids and a marijuana issue lol. I'm surprised none of the Patchies have not asked for an investigation into Jacob Lynne as a major international narcotics trafficking ring. lol

Umm Mathew it quite obvious you can't read or you just decided to pick and choose words that make your MORON argument seem right. The facts are. Amendment 64 which really is an amendment to Article 18 of the Colorado constitution says in Section 3 will allow the "personal use and regulation of marijuana" for adults 21 and over. Last i check these to low life scum criminals are not 21. New liberties of Amendment 64 apply to people 21 or older. People can grow up to three immature and three mature cannabis plants privately in a locked space, legally possess all cannabis from the plants they grow (as long as it stays where it was grown)Last i read these guys weren't at home. So tell your boy friends a lot of people out here will be clapping when they are thrown in jail were they both belong. Now get out of your parents basement get a job and put down your bong. LOSER
