Ditka Lawyers Hope to Avoid Trial

Michael Ditka is scheduled to head to trial for DUI charges on Nov. 28. However, the Deerfield resident’s defense team indicated Thursday in court they hope to get those charges dropped at a hearing in October. 

The son of former Bears coach Mike Ditka was originally arrested on April 20. Police say they spotted his Hummer leave the Deerfield Village Center around 11:45 p.m. and drive into the rear parking lot of the Building. According to a police report, when officers approached the parked car, police said Ditka had “red blood shot eyes and slurred words.” But according to Ditka’s lawyer, he wasn’t actually driving but instead sitting in a parked car. Court records show this is Ditka’s third time being charged with drunk driving.

According to Lake County Assistant State’s Attorney Robert Money, the defense has filed a motion to suppress various pieces of evidence in the case.

Money told Patch that Ditka’s lawyers allege there is no probable cause that the 49-year-old has committed or was about to commit a crime. Money also stated the defense is arguing a DUI cannot be alleged because it didn’t occur on public property.

Money said Ditka’s lawyers believe this motion to suppress will result in a dismissal of charges at an Oct. 27 hearing. However, Money plans on going to trial on Nov. 28. That date was set by a judge Thursday. 

If convicted, Ditka could face three to seven years behind bars and a $25,000 fine. He pleaded not guilty to the charge during an arraignment hearing in July.
