Livingston first told police the female—he is her tennis instructor--texted him she was at a party, was drunk, was walking home and was lost, according to the report. He came to get her. He also said he immediately deletes messages from his phone after he reads them. He also said he did not provide the alcohol.

During an interview at the Deerfield Police station, Livingston “became more and more nervous,” according to the report. Police asked permission to search his car, received it, and found orange juice, an open bottle of vodka and a receipt from a Jewel store in Skokie. After that, Livingston said he picked the female up at her house and purchased the vodka. He was released on bond.
