Bill Rejected: Sheriff Keeps Responsibility for Foreclosures

Lake County lobbies successfully against Foreclosure Sale Bill.

Lake County leaders celebrated the defeat of HB1293, a bill that would have allowed for-profit foreclosure companies to conduct the foreclosure sale process, instead of the sheriff’s office.

“Our courts and sheriff’s office have been providing counseling, information and compassion in this very emotional time for homeowners going through the foreclosure process,” said County Board Chairman David Stolman.

The bill would have allowed banks to choose whether the county sheriff or a private firm handled the foreclosure process.

The Lake County Sheriff's Office currently conducts the mortgage foreclosure sale process and provides information about the defendant's rights, as well as available social or legal services. The sheriff’s website contains current information on every foreclosure case.

Stolman said the process is very compassionate and transparent.

"I care deeply about our residents, especially those who are going through the painful experience of losing their home. I want to thank our state delegation for doing the right thing,” said Sheriff Mark Curran in a statement.

The Lake County Board and Sheriff, as well as sheriffs from across the state, opposed the bill. The bill failed in a House vote, by 59-49, May 31, with the help of nay votes by representatives from Lake County.
